Sam Shaulson is a New York Morgan Lewis lawyer who represents Citibank, a scumbag operation that launders Mexican drug money, tricks college students and steals from innocent customers using sweeps accounts. Ohio AG Marc Dann v. Citibank (I worked in Ohio AG office, they do some good things from time to time) read it all right here, along with California AG Edmund Brown's press release on the sweeps theft. But not only that, now Bloomberg Business Week is reporting that the California authorities are tossing subpoenas there way over the illegal practices involved in mortgage securitization. All of this is par for the course because they even stole from a woman with uterine cancer.

Here's the question: Why haven't these pigs done any jail or prison time?

Please see the four transmissions of the Notice of Media Appearance that were sent to both offices at Phelan on 27 July, 2011 -- two (2) full days before my appearance. I also found the hit the firm placed on my journal after that and am forwarding as screen capture attachment. I have a tracker and I know they are lying scumbags like many of the lawyers I dealt with over the past twenty years. The difference is now we have broadband and much more technology to keep them in check and turn the game around.

As a matter of fact I am going to file an Ethics Complaint with the NJ Bar Association based on this conduct and forward it to attorney John Narkin who is suing them in a huge class action case.

Okay I was just getting ready to head down to the Courthouse to check up on the status of the Robert O'Connell, Joseph Fasano, Jennifer Bynarowicz Quincy Cocaine road rage shooting in which Fasano -- with a known domestic violence past -- was reported to have cocaine on his face. There was cocaine in the Bynarowicz Jeep and she copped to it as seen by the KingCast court file investigation.

"Who did you get the cocaine from?"

"You [won't] believe me," says O'Connell.

Interesting. You might want to check and see who carried the insurance on her Jeep, I dunno it might be relevant, it might not. Just sayin'.

But now we apparently have much more than that going on folks, as the Boston.com screen capture shows... William S. O’Connell, who is O'Connell's uncle ~~or father~~ and former State Senator, was popped for 19 golden grams and Stat Rape with a kitlin' 14-16 years of age..... Whoa. See folks have been telling me that years ago one of the elder O'Connells' friends turned up dead off a yacht during a little cocaine party and I have told these people that I will always report what is reasonably true. At this point I cannot -- nor can anyone -- actually substantiate the yacht party cocaine but I now feel comfortable enough to mention the rumour on my page.

Note that the Patriot Ledger's excellent coverage mentions the incident and the dismissed drunken operation charges as well as his son's second-degree murder in the stabbing death of 22-year-old Julie Hamilton, who knew Matthew through her boyfriend. Matthew O’Connell is being held at Bridgewater State Hospital, a medium-security facility for inmates deemed in need of psychiatric care.

United States. It continued to issue CDOs after mortgages

began losing money at record rates, investor interest waned,

and its most senior CDO trader concluded that the mortgage

market in general and the specific RMBS securities being

included in the bank’s own CDOs were going to lose value.

And lastly, when it comes to ponzi schemes remember that NH AG cum U.S. Senator Kelly Ayotte was found negligent in the largest consumer fraud scandal in New Hampshire history the FRM debacle. Well I’ll be a monkey’s uncle. This is potentially a case of first impression because I can’t find any other case where an adjunct, associate or full professor withheld resume information about being a Convicted white-collar Felon.

Not only is Columbia University’s Adam Klein a convicted felon, but if the mother of his first child had been given the opportunity to argue her case, he may well have been returned to South Africa for imprisonment because he arguably committed Perjury during a series of lawsuits in Massachusetts. One such lawsuit was filed by Frank Kinzie of Quantum Associates, and it pertained to $90K of the attempted $320K heist that Klein attempted. If you would like me to pull the file I can do that for you and send you the pertinent documents excepting the confidential Settlement Agreement.

At the time he potentially committed Perjury in a Deposition with Mr. Kinzie, Adam Klein was subject to a Good Behavior Order as seen below, kind of like another one of my investigative subjects Gregory Floyd was under before he violated it…. And went to prison, where he sits today subject to a lawsuit NH Dist 2010-CV-181 that came about largely because of my efforts.

But I digress.

I raise these issues in the context of the quest for Journalistic Integrity that binds all of us together as professional journalists.

By now even the casual observer of this journal knows that I edited the Cincinnati Edition of

Ohio’s Call & Post, the only statewide black-owned newspaper before I reported with the Indianapolis Star. You should be familiar with these publications, as we both hail from the Buckeye State.

After law school I came to watch my first cousin blossom into the most recognizable black (or any other) sports journalist in the World. This is why I notified his alma mater of this issue. And his cousin was in turn one of the most recognizable black (or any other) anchors in the World. In point of fact she moderated a U.S. Presidential debate.

While they pursued more traditional paths in journalism, one thing that all of us have in common is that nobody could make a legitimate argument that any of us knowingly misrepresented anything on a job resume or in a story or journal entry.

Sadly, unless Columbia’s policy allows for Felonious faculty members, it does not appear that the same cannot be said for Columbia adjunct faculty member and eMusic CEO Adam Klein.[1] If he lied on his resume or application the simple fact is that he could be fired and the termination upheld even if he was fired for a different untenable reason and after-acquired evidence uncovered the falsification. Jordan v. Johnson Controls, 881 S.W.2d 363 (1994), Redden v. Wal-Mart Stores, 832 F. Supp. 1262 (1993)(black employee had theft by conversion conviction, ahem). In Colorado v. Saga Communs., 11 F. Supp. 2d 1292 (1998) (omitted and concealed a place of employment 10 years prior) provide the relevant analysis for us:

However, the Colorado Supreme Court, relying extensively on Gassman I, has addressed whether resume fraud acts as a complete bar to breach of employment contract claims:

[We] hold that after-acquired evidence of resume fraud may provide an employer with a complete defense to such claims.

To assert the defense of after-acquired evidence of resume fraud, an employer must prove that the employee's fraud was material and that a reasonable, objective employer would not have hired the employee if it had discovered the misrepresentation at the outset. The following factors are relevant to that determination.

First, would a reasonable employer have regarded the misstated or omitted fact as important? The nature of the misrepresentation and the extent to which it relates to qualifications for the job may bear on this issue.

Information about the employer's past conduct or policies may also bear upon this issue by focusing on what the employer regarded as important in a non-adversarial context. The second factor is whether the employee concealed or misrepresented the fact or facts with the intent of creating a false impression in the mind of the employer, citing Crawford Rehabilitation Services, Inc. v. Weissman, 938 P.2d 540, 549-50 (Colo. 1997) (en banc) (citations omitted).

As noted in one of the prior journal entries, I have had very close association with associate professor staff at Columbia and personal friends who have graduated from Columbia over the years, this will happen when you go to prep school. And again, each and every one of them is a stand-up individual as are their friends whom I have met in NYC and throughout the Country. As to the Professor, had there had been a pregnancy and child born I would have stood by whatever agreement we made, unlike Adam Klein.

Regardless of Adam Klein’s familial issues, it is clear that Senior Staff owes the International Academic World an explanation on this for several reasons:

First, every job application asks the Golden Question, “Have you ever been convicted of a Felony?” Without making too complex a syllogism here, let’s just say that whomever did the vetting didn’t care or Adam Klein lied. Either way an explanation is in order.

Second, this is a newsworthy event because it almost never happens. We’re used to seeing community college cocaine-smuggling falsifiers like David Silbergeld get the hook, or Harvard’s monkey-man Robert Fogel catch a reprimand from the U.S. Department of Health and Human Services after his misdeeds. It takes a while to prove data falsification. The same goes for Harvard’s Marc Hauser or MIT’s Luk Van Parijs, who was fired for data-doody as well.

Living a material lie and using that lie to gain access to the University before you commit further misdeeds cannot be tolerated either, and some learned Judges believe the gross falsification is an absolute bar to employment in the legal context.

Office of Disciplinary Counsel v. Ragbirsingh, 535 Pa. 587 (1994).

The Disciplinary Board favored a three-year suspension. This Court is prepared to accept the latter sanction. I dissent on the grounds that the only suitable course of action is to issue a rule to show cause why he should not be disbarred.

The central focus of our attention should be on the issue of itself. This is not a case where an attorney was admitted properly and subsequently engaged in unprofessional [***4] conduct. Rather, the conduct runs to the question of whether he was eligible for admission in the first place. As I have indicated in my accompanying dissent in Office of [**266] Disciplinary Counsel v. Deborah Griffin, 637 A.2D 266, the Commonwealth has a reasonable right to reconsider that admission itself……..Failure to disclose falsification should be treated as fraud on the Court: it destroys all subsequent proceedings.

As such, this is not Weinstock v. Columbia Univ., 224 F.3d 33 (2000) where we are sharing opinions on whether or not someone with a proven Academic track record (and no criminal record) gets tenure. No Sir, No Ma’am. Here we are merely talking about holding the bar of admission somewhere north of the cesspool.

I’m quite certain that a lot of people in the Office of the Provost are mulling this one over as you should. As you must. As you do that we cannot forget that the University Press has an obligation to monitor, to police and to report (5 points for parallel structure) lest it fall short of the duties and responsibilities incumbent on the Fourth Estate.

I have more information than I’ve let on, but for now I will sit back and watch, perhaps wait for a phone call and just see whether one of the Institutions that earned my trust and respect – and there are not many of them in that category – deserves to keep it.

[1] I am all in favor of CORI reform here in Massachusetts for the rank-and-file employee who makes a single youthful misjudgment, but white-collar crime involving a corporate executive and professor with discretionary authority is a horse of another color. Incidentally, Massachusetts is where Adam Klein’s daughter sits, waiting for her father to show her or her mother any measure of respect. This is odd given that Klein pursued her in the first instance by leaving a note on her car approximately 8 months before his daughter was conceived. He had been watching her take laps in the pool. The sexist Massachusetts Court of Appeals in issuing a not-for-record Opinion on the contractual agreement that Klein stopped paying 6 years in wrote that they had “a rather brief relationship,” implication being obvious. I won’t tolerate it, it takes two to tango, and this tango lasted for the better part of a year, folks. Just the facts.

While the Washington GOP establishment is reportedly courting Ayotte as the “younger, dynamic female senator” emblematic of their new moderate façade, she's apparently seeking the tea party's seal of approval.

"We only get into races when we are asked,” said FreedomWorks spokesman Adam Brandon, indicating that Ayotte sought out the group's support. Brandon said FreedomWorks made the endorsement only after gaining "consensus from our guys on the ground -- we can’t endorse if our activists’ membership is spilt."

I blogged about Amy Goodman's situation involving the 2008 RNC beat down and 800 arrests in this post. Here is the Truthout 9 May, 2010 feature on the lawsuit, filed by the Center for Constitutional Rights.

I mentioned it at 8:30 of the KingCast movie (above) showcasing several forms of viewpoint and content-based abuse leveled at me during the GOP Joe Arpaio love fest in Nashua, NH one week ago to the Day. Now let's see if GOP Secretary and Committee Chair Karen Thoman grants my requested apology for whacking my camera with her GOP flyer at an even that most certainly was NOT private, as anyone could buy a ticket and other media were there.

Anyway, King's video is entertaining mainly because of what happens to him: A GOP hausfrau whacks his camera with a pamphlet; some Republican crone orders him out of the building; and the local cops force him to amscray under threat of arrest, even though he's credentialed and there are plenty of other media types there. The video's a tad long at 12 minutes-plus, but worth every second.

Not to mention the fact that Kelly Ayotte threatened to arrest me 2 weeks prior at a public event advertised on Facebook no less, watch the video.

And I am talking about moving for Injunctive relief with some well-respected local First Amendment Counsel as well. And the compelling thing is, I need immediate relief because the fall elections -- in particular the U.S. Senate 2010 race -- loom large. In contrast, the relief sought against the RNC is temporally stale by comparison, though no less significant of course.

That's why they have no responsive documents to the first three (3) out of five (5) RSA 91-A Public Records requests. These requests are heavy and they concern fingerprint analysis, gunshot residue analysis and information how How Gregory Floyd may have unloaded the first clip and loaded the second clip of Liko Kenney's Hi-Point to make him appear more dangerous AFTER he shot, and likely murdered him. That's pretty much the only way you go home with one of Liko's live rounds in your shirt pocket, which is exactly what Floyd did. And that's a FACT.

After he shot out Liko Kenney's winshield and lied about it, of course. I proved all of that with the official court documents hosted at the Casey Sherman "Bad Blood: Freedom and Death in the White Mountain" book launch. This is why US Senate Hopeful Kelly Ayotte threatened to arrest me at her public event 3 weeks ago when I showed up to ask a few simple questions, as noted in the bottom video.

Anyway, King's video is entertaining mainly because of what happens to him: A GOP hausfrau whacks his camera with a pamphlet; some Republican crone orders him out of the building; and the local cops force him to amscray under threat of arrest, even though he's credentialed and there are plenty of other media types there. The video's a tad long at 12 minutes-plus, but worth every second.

Basically, these folks don't like King because of what he reports and posts. I feel your pain, senor. Consider it a badge of honor that they booted you out.

There are going to be some discussions with NENPA a potential panel discussion and forum at this winter's NENPA Conference in which Your's Truly will be more than glad to participate with any and all bloggers and freelance reporters across the political and ideological spectrum. If the kinds of abuses that I received were given out by the Dems, I would be just as much in their face as I am the Republicans. Last night I told you that I am narrowing my issues for Police Chief Conley regarding the Assault/Disorderly Conduct/Harassment I received from Karen, who reached out and struck my camera in a most unprofessional manner. And I told you that she did it with a smile on her face and with glee, standing right next to a white police officer who didn't even say anything to her, but who did then admonish me not to hit or to strike anybody. Now my complaint against that bigot is a separate issue but for now let's stick to the simple fact:

You don't offensively touch anybody else or their possessions much less a relatively expensive camera, without their permission.

That's pretty simple isn't it? It is a tort. It is certainly more simple than the School Board issue. So as I say, I'll be traveling for the next week but when I discuss this with you next Wednesday I would hope to have this matter resolved with a simple apology because I don't give a damn what kind of absurd excuses my Internet troll haters raise up, I was on my zoom lens and well more than an arm's length away from her, she reached out and struck my camera, and you can see it in slow motion for Pete's sake.

Watch the woman apologize to me for calling me a bigot at Kelly Ayotte's other rally where she also threatened to have me arrested despite an open Facebook invitation. The two of us then had a nice and informative talk, same with the bloke to her left, a Dartmouth professor and tennis player. That's how I am, OPEN. But I won't take any bullshit, never have and never will. I am a member of the media, and I don't cease to be a journalist just because I left a daily to go to law school.

1. The New Hampshire Supreme Court allowed a Bad Cop named Martin J. Dunn, and his establishment lawyer Dan Mullen (former Kelly Ayotte waterboy) to repeatedly lie about me to the Court and get away with it. Specifically , they lied and said I was "disbarred," they lied and said that I "misrepresented [myself] as being licensed in New Hampshire," they lied and said I wrote a "Fraudulent letter" from the NAACP (see NAACP Veteran's Chair Cleaven Ferguson's Affidavit) and they lied about me saying that Dunn raped his daughter. In reality it was Meshugana Marty laughing at a racist hate mail to me that said

"You better save your food stamps you goin' need protection where you're going, you bout to be Bubba's bitch."

All of these matters invoke Rule 3.3 Candor to the Tribunal concerns, and they besmirch the Court and legal community, but as two duly licensed area attorneys (and I mean partners in well-respected law firms) noted to me "King, don't you know you're messing with good white people, and you are a black man in New Hamsphire without the kind of power or money to do that. They hate you." And that's purely evident that they do not care about Justice, Truth or Accuracy.

2. The GOP attacked me at the Jeff Arpaio rally and there is no question but that if I had struck one of their cameras the same way that I was struck, I would have been arrested, pronto, never mind that Mayor Streeter gave me a Mayoral Commendation for all of my diligent First Amendment work. The cop stood right there and criticized me instead of admonishing this white woman who lost her cool and broke the law, smiling with glee the whole time, the video doesn't lie, folks. I telephoned Police Chief Conley this morning and he never returned my call, so I will go see him in person tomorrow and file my complaint.

Now the Michael Holman case is getting interesting as well. Kelly Ayotte's office received dozens of pages of information about Unconstitutional practices against him by Madison Chief John Pickering that have allowed his children to remain in the care and custody of a negligent mother while issuing bogus threats of arrest and trumped-up charges against him. Even the Boston FBI is aware of a substantial file that they obtained from the NH AG in 2009, as noted in its initial review, which has since been revisited. Congressman Jay Inslee and others are looking into that matter, meanwhile read his position statement and FOIA/RSA 91-A Right to Know correspondence (referencing 19 pages of now-missing documents) indicating that the NH AG's office -- under Kelly Ayotte -- destroyed his entire file except one page.

Congressman Inslee's 15 October 2007 letter acknowledged a huge packet of information, much of which should have been on file with the NH AG's office.

Supporting Unconstitutional practices is nothing new for Kelly Ayotte, remember her run at me as NAACP Legal Chair, her support for Unconstitutional DNA reporting for NH youth and her deceitful misrepresentations in losing the Planned Parenthood case, while claiming that she won? Kelly Ayotte real legacy is well documented right here.

Maybe that's why TPM shows Ayotte in trouble, and even the conservative Union Leader -- which itself has been a potboiler for political corruption in the past, recall Ed Muskie and the Canuck letter -- endorsed Ovide Lamontagne in the Republican 2010 U.S. Senate race.

The case of Darrell Jones illustrates how petty and vindictive the relationship between guards and inmates can be.
In May of that year, Jones charged, in an audio clip posted online, that officer harassment of inmates had reached its "highest level ever," and complained, "They're tearing down anything we try to do that's positive." The day after his tirade went public, Jones was placed in segregation.

Six days later, Jones' appeal for outside help appeared to have been answered: he received a visit from State Rep. Gloria Fox. Accompanied by Jones's girlfriend and collaborator Joanna Marinova, Fox had come to discuss claims of officer misconduct leveled by AHC members. The day after that meeting, Jones was relocated to MCI-Norfolk.

A civil action will examine whether OCCC officers manipulated the media to retaliate against Jones. In May 2009, the Boston Herald ran a page-one story titled "Fox in the Big House," in which reporter Jessica Van Sack wrote: "State Rep. Gloria L. Fox is under scrutiny for allegedly sneaking a murderer's girlfriend — previously bagged for engaging in 'sexual acts' with the killer con — into [OCCC]." Citing two confidential sources, the article claimed that Fox, the state rep from Roxbury, used her legislative privilege to bypass security checkpoints for the purpose of escorting Marinova into restricted areas where she could see Jones. In the month that followed, the Herald trumpeted the story despite proof in disciplinary reports that charges of "sexual acts" between Jones and Marinova had in fact been dismissed by OCCC supervisors. Marinova is suing the Herald and WHDH-TV7 over the story, claiming the outlets based their reports on false information that was maliciously leaked by OCCC employees.

2. Boston Phoenix – Look this week for their review and investigation into the Draconian measures at Old Colony. Turns out that Darrell Jones and Joanna Marinova were not the only victims of the sexual misconduct write ups. Remember, the dirtbag “journalists” chez Boston Herald and Channel 7 WDHD turned that into “had sex with inmates….” All of which was FALSE and resulted in a massive pending lawsuit, and DOC/EOPSS IT/Communications Director Terrel Harr tells me there are subpoenas issued to his office, probably from the Defendants, who are about to get their fannies handed to them when they get the responses and schedule Depos.

3. PressPass TV, KingCast – Watch the video with wrongly-convicted prison reformer Darrell Jones, who has personal correspondence with Senator John Kerry on these matters. Here's your back story. Michael Picardi's lawyer, Charles F. Jordan, is a pretty interesting guy. Anyway they filed a Motion to Dismiss and he ordered his client not to come out, so I'll have to wait for the Trial or the Plea. Meantime we shot the shit about baseball, it was a very compelling discussion I'll say that, but that is strictly for those of us who were there to know :)

It is a very interesting case, legally, as it involves 274/4 Accessory After the Fact and 268/13B/A Witness Intimidation. The actus reus is different for each crime, I will explain later when the Court rules on his Motion but some of it of course deals with his little Conspiracy to Lie with Mr. Slap-on-the-wrist Derek Lodie. In fact, Lodie got such a walkover for fabricating evidence, stabbing someone and lying about it that would be logical to question whether he has something on somebody, like if the Revere PD had jacked him up for an 8Ball or something the night Dan Talbot died but agreed to keep quiet about it while he fingered Robert Iacoviello. Given the sheer amount of BS in the Dan Talbot murder trial , including magic casings that land on Gatorade bottles, one has to ask.

I seem to have dropped the audio here but not to worry, I'll be there for the next hearing and the trial or Plea Agreement, and so will Mr. Picardi at that point. But what about the lack of toxicology tests and results, I'm going to ask my First Amendment Foe DA Dan Conley for that, remember I was on this back in February, 2008 and that's one reason that dude can't stand me. So be it, I'm gonna say what I wanna say, and ask what I wanna ask, this is America, dammit.

WHEREFORE, DA Dan Conley: Please provide a copy of any and all full toxicology reports for each and every Revere Police Officer who was present at the Revere High School at any point during the evening that Dan Talbot died, per MGL 66 § 10.

Soooooo......I just received a nonsensical letter from Mass AG Martha Coakley’s office in response to my request for any and all documents evincing any investigation into an unauthorized CORI leak, relative to Marinova v. Boston Herald, Jessica Van Sack and Channel 7. A fun video of my follow-up visit, a copy of the letter itself:

“There are no documents responsive to your request…. (also) It appears from the evidence you provided to us, your complaint does not constitute a CORI violation."

Here's the underlying CORI/Defamation case where the Herald and Channel 7 said Joanna Marinova had sex with an inmate in discussion on Beat the Press. The information leaked about Darrell Jones is clearly not of a public nature, much less does it indicate that he and Ms. Marinova had sex while they were working on Prison reform with State Rep. Gloria Fox, for Crissakes...... And here is Joanna Marinova at the Mattapan Public Library screening her award-winning PressPass TV videos, "Voices Behind the Wall" and "Mr. President," made in conjunction with noted prison reformer and wrongly-convicted inmate Darrell Jones. First off, it's not my complaint that I'm alleging was a CORI violation. If Attorney Tarrow means to say that the underlying subject matter of my complaint was not a CORI violation, that's another thing.

Second, The problem is, she would be wrong there, very wrong per Globe v. District Attorney for the Middle District, 439 Mass. 374 (2003). The Holding reads in pertinent part:

"We therefore conclude that the wording of the declaratory judgment must be modified to limit it to those record requests that are framed entirely in terms of information that would be available from court or other public records, as only those requests call for disclosures that are entirely exempt from the CORI statute. The case is remanded to the Superior Court for modification. The declaration should be amended to read as follows: "Docket numbers of criminal cases prosecuted in public judicial proceedings, correlated with information that is also available from court or other public records, but not correlated with defendant-specific information, are public records under G. L. c. 4, s. 7, Twenty- sixth, subject to mandatory disclosure under G. L. c. 66, s. 10, and their disclosure is not prohibited by the CORI statute, G. L. c. 6, s.s. 167 et seq."

Her boss, Deval Patrick, twice publicly stated to me, at his Town Hall meeting and during an impromptu Juneteenth meeting that his administration was going to "conduct a thorough investigation" to "get to the bottom of this" (Town Hall) and that he would "put it to bed" (Juneteenth).

Attorney Coakley, obviously he disagrees with you, but if the investigation is closed please produce a copy of any and all documents you have in your possession. If you produce nothing I will assume the investigation

a) is open, proving you wrong, ipso facto.
b) never occurred.

Where was she on the Cat Gibbons case, where her Division of Banks erroneously and selectively targeted one of the State’s only black female mortgage brokers for doing Stated Income Deals, even though none of her Deals resulted in foreclosure and she put no one in Harm’s Way. Good Thing that KingCast cameras came out, and the KingCast network of attorneys got involved and Ms. Gibbons will be able to apply for her Loan Originator’s License immediately, and her Broker’s license in a few months, rather than the permanent revocation that the DOB explicitly stated it was seekin on the record -- and in KingCast video.

A) Please provide documents showing the investigation to be closed.
B) Also provide documents that show the total amount of fines assessed against any and all real estate companies engaged in providing mortgages for the years 2006, 2007, 2008, and 2009.
C) Further provide documents that show how these monies were applied to the State Budget, and what departments and agencies received funds from these fines.
D) And while you're at it, please provide an accounting of all monies derived from motorcycle registrations by Massachusetts General Law (MGL) Chapter 90 Section 34 for each of the calendar years 2000 through 2010, inclusive to date. As you are a skilled and professional attorney I'm certain you will have advised your boss and client, Governor Patrick, to take care of this.

2. As to rape, Attorney Mullen knew that the Truth of the rape issue was that his client laughed about the prospect of me being raped during a deposition in which Dunn was reading some hate mail directed at me that read, in pertinent part:

The relevant passage from the Transcript in which Dunn said “That’s a funny letter you’re asking me to read” after I said “Let the record reflect the Deponent is laughing” is attached in the Pleadings, and Dunn and Mullen both knew it because they read my KingCast.net blog “Chris King’s 1st Amendment Page” and even cited to it in the High Court Pleadings, thinking they would never hear from me again. They did not realize I have friends in High Court Places. Again, when it came time to approach the High Court for Certiorari he juiced up his pleadings to make his client look more vulnerable, and that is odious, contemptible and sanctionable conduct.

WHEREFORE I can find no reason why Daniel J. Mullen should not be disbarred for this willful sort of conduct, or at a minimum receive a substantial suspension and fine.
If this Court does not punish this sort of activity it sends a Green Light to large, powerful Defense Firms that they can say and do anything to represent abusive Law Enforcement in New Hamsphire, and get away clean. As a former Assistant Attorney General -- as was Mullen, see picture at Attachment 3 – I would find that to be an untenable position, to say the least.

“Bad Blood: Freedom and Death in the White Mountains” is a book and pending screenplay by Boston area writer Casey Sherman, whose Aunt was the last Boston Strangler victim. Sherman basically proved that the guy they fingered and convicted DiSalvo, IIRC didn’t do it.

Flash forward to this case, in which Kelly Ayotte closed an investigation in 24 HOURS into the possible murder of a young man who shot a bully cop. He was such a bad cop that the town and NH Legislature refused to name any section of a roadway after him, an unheralded move in the SB 154 hearings.

That was during Kelly Ayotte's failed attempt to prosecute me for Unauthorized Practice of Law, just after her idiot LE friend Martin Dunn nol-prossed a bogus case of Attempted Felony Extortion against me after I exposed police abuse under his watch.

This is part of my Second Supplemental Pleading for mailing tomorrow. The Supplemental Pleading filed earlier today is posted along with the Second Supplemental Pleading, seeking a finding that Martin J. Dunn and his lawyer Dan Mullen committed Fraud upon the Court.

As noted in this post with the Motion to Intervene, the NH Supreme Court reversed Martin Dunn's lies about me being "disbarred" as manifest by and through his counsel, Dan Mullen. I wrote a Supplemental Pleading that I will post later, and it showcases the indisputable FACT that Dan Mullen, of Ransmeier Spellman et al., knew I was suspended and said as much before the Retirement Board where he lost his case, but only juiced up the pleadings to say "disbarred" in an attempt to gain Certiori before the Supremes.

His Fraudulent activity worked, he got Cert and a reversal for his bubble-head client.

But meanwhile, Dipshitz Dunn (as correctly heralded by his peers) and Mullen actually had the nerve to claim that my Demand Letter about the police abuse suffered by Willie Toney was "fraudulent" but he and his client knew better. They knew that the only NAACP Officer Affidavit thoroughly supported my position, that I lied about NOTHING and told the NAACP brass EVERYTHING. Read it here.

Query, did Dunn tell him that? Did Mullen believe him? Did he engage in Due Diligence to check the blog or to ask for a printout (that does NOT exist because it never happened)..... This is pure poppycock, and Dan Mullen and his client knew -- by virtue of the very same Internet posts that they loathe -- that I never issued any fantasy comments about Dunn raping his daughter. No, in point of fact that sad truth was that Dunn was having fantasies about me being gang-raped in prison, read the letter that he thought was funny ("you 'bout to be Bubba's bitch you coconut head racist") and the attendant transcript above. Just the FACTS.

Meanwhile Dunn whines that I called him a "white cracker" well ain't THAT the pot calling the kettle black.

But what's worse than that is the fact that his lawyer jumped in bed with him and worked the lie too, making him no better than his client, some might say even worse because of his moral and ethical obligations to the Court. Now that's one ugly two-headed beast, that.

Lastly Dunn continued to lie about me and told Charlie Duffy in this March, 2006 email that American Tower Corporation had to have police escorts to fire me; walk me out of the building. More poppycock. There were no escorts, just a pissed-off company who had to pay $290K to the Department of Labor after I ratted them out for not paying my trainees overtime, and that's another FACT, call Attorney Corey Surett, he remembers me, or simply read the DOL press release.

.......Let this be a lesson to fired Chief Martin J. Dunn, Dan Mullen and to other blue blood attorneys at Big Firms: Do not assume you can lie at will and get away with it, because sometimes you will get caught, and sometimes you will be punished, one way or another. The types of lies and even physical abuse I suffered at the hands of some of these lawyers in the 90’s (read: Luis Alcalde, Esq) will not be tolerated anymore. We are in a New Era of Communications with the Internet, and viva la difference.

Your 19 August 2010 opinion in Martin J. Dunn v. NH Retirement System stated:

Around October/November 2005, Dunn discharged a police officer, who then obtained union representation and filed a grievance against Dunn.

Well guess what? Dunn and former NH AG Kelly Ayotte lost all aspects of that case, and Jury acquitted Aaron Deboisbriand in about an hour. His father and I kept in touch throughout the case and throughout my case because Dunn and Kelly Ayotte are known to be feckless, but dangerous in their own ways.

It then stated:

In addition to budgetary challenges, Dunn faced a number of stressors beginning in 2004 and continuing through his final day of work in July 2006. In December 2004, Dunn received a letter on NAACP stationery threatening to sue him and the police department. This began a lengthy dispute waged both in the courts and on the internet between Dunn and the letter’s author, a disbarred attorney. Although the letter-writer’s lawsuit against Dunn was dismissed in late 2006, the internet attacks continued.

Well that's not exactly accurate..... First of all it was MassCops who called Dunn a "Slime Bag," not me.

Second, before I kicked his butt in the Criminal case, Martin J. Dunn thought it would be funny if I got gang-raped in prison, i.e. "You 'bout to be Bubba's Bitch," read the transcript.

Third, what happened was Dunn continued to lie, claiming I was disbarred and found guilty of practicing law without a license (both lies) and I warned him about it in your so-called "Internet Attacks" you mention during your little pity party for this feckless cop.

Fourth, I am not disbarred so you need to correct that immediately, the same way that WMUR did when I flagged them on it when another idiot cop said I was disbarred. Read the retraction right here.

Fifth, your opinion fails to mention the bogus case for Attempted Felony Extortion that Boy Blunder brought against me even after I specifically asked to present the facts to the Grand Jury. I schooled them good, (UL coverage) and the State failed to prosecute its bogus case after I sat through Voir Dire with my lawyer, former lead Hillsborough Prosecutor David Horan. Idiot Girl Kelly Ayotte's case for Unauthorized Practice of Law was DISMISSED.

Sixth, Martin J. Dunn (and NAACP President Gloria Timmons) lied under Oath when he stated that I had not read the police reports about Willie Toney being before I wrote the Demand Letter. Read the transcript. I knew Toney, a black man, had faced three (3) drawn guns from white officers and a visual body cavity search for LOITERING -- I had read these police reports right here -- and he beat that case pro se, without a lawyer.

Seventh, Dunn's termination was affirmed by former NH AG John Arnold.

Eighth, Prosecutor Bill Albrecht resigned amidst an Ethics Investigation.

This information was readily available to you and you should have known better. I am much too busy with Courtroom and other video to have to take the time to follow in behind you and clean up your mistakes.

Surely Judge Dalianis should have known better, I know her son and when he worked for Mayor Streeter I was awarded a Mayoral Commendation for my hard work in changing First Amendment Policy in Nashua with Alderman Teeboom and for my investigation into the Franconia Shooting tragedy, idiot AG Kelly Ayotte giving taxpayers the biggest cover up in NH Legal History except for the Dow Murders. Heck I got a Decision on RSA 91-A Right-to-Know against her, take a look.

I ought to sue you for Defamation, but I'll settle for an immediate retraction. Just because I annoy you does not give you the right to tell lies about me, do you understand that yet? Thanks for reaffirming everything I thought about NH "Justice."

Please issue the correction forthwith, or I will Commence Legal Action. You are the High Court of the State, and you have a responsibility to get it straight before you publish, not after. What did you think my people wouldn't keep me informed of things like this, or did you -- like former Chief Dunn -- think you could just say and do anything to a black man and get away with it?

He couldn't and you can't, either. Now go back and get it straight.

These scans are from a case raised by the Union Leader in a 19 October 2007 Editorial, "Gagged by Nashua: What's Michael Paulhus's story?" Read this post to see why they are relevant to the Malfeasance manifest by Robert Walsh. I believe he was in part responsible for investigating the Christopher J. Micklovich Strange Brew beat down by the Manchester Pee Dee, he completely failed in these two instances. When I get home I will image the Returns of Service in Liko Kenney v. Gregory Floyd et al. and place them on top, you will see why they, along with the Kish Report, are relevant to understanding how the NH Legal system "works."

In today's UL Editorial, "Hillsborough County attorney admits mishandling case," in which he clearly closed out two cases without due investigation.

"I feel it is important that both the community in general and the law enforcement community know that I did not use the usual chain of command and protocol in discussing a resolution of this case," Walsh said. "I acted too quickly. I recognize this is unfair to the chief of police and the victims."

Unfortunately, his actions were par for the course under the previous AG Kelly Ayotte, who, inter alia:

1. Allowed key evidence to be destroyed in the police shooting of Michael Paulhus, the UL's own Oct 19 2007 story referenced the case and raised questions about the confidentiality provisions of settlement in their own editorial: http://tinyurl.com/3ahoenb

....but did not mention the FACT that key items of evidence were destroyed under Ayotte's watch. Read the independent forensic review by Googling "Paul Erwin Kish + Paulhus."

2. Gave Greg Floyd a pass in 24 hours after he shot Liko Kenney, even though he issued materially conflicted statements about his actions and speaking to Kenney prior to shooting, as noted by well-respected Author Casey Sherman in video and in his book, "Bad Blood: Freedom and Death in the White Mountains." When a Nashua man sued for information Ayotte said that she had no fingerprint analysis (Floyd could have placed Liko Kenney's second clip in his gun, seeing as he went home with Kenney's live round in his pocket) nor was there any Gun Shot Residue analysis provided even though I know they tested for same on Caleb Macaulay's clothing.

Nor was there any analysis of the windshield bullet that was lodged in Liko Kenney's car, which could also prove that Floyd lied about his actions. Read more about Kelly Ayotte's history of malfeasance (including the Paulhus case) and watch related video right here.

It is going to take a lot of work to restore any semblance of decency and fairness to the NH AG's Office, Mike Delaney has his work cut out for him.

You promised me that you would investigate Mayor Menino's missing emails and you did, finding no criminality on the part of Mr. Kineavy or anyone in the administration. I've got video of His Honor discussing that at a recent motorcycle/scooter event.

But in this case you have apparently not taken any action despite the fact that there is clear cut criminality and/or government malfeasance Everybody at Beat the Press knows it. See Globe Newspaper Co. v. District Attorney for Middle Dist., 439 Mass. 374, 788 NE2d 513 (2003) read para. 5. But Jessica Van Sack may indeed find herself in the exact same situation that Toni Locy was in, facing contempt of court charges in that $5.8M Settlement in Hatfill v. NYTimes, infra, for failing to name confidential sources BECAUSE OF THE ILLEGALITY INVOLVED.

In fact, the violation was so obvious, and with Marybeth Heffernan so focused on meeting with Ms. Marinova.... (again, Heffernan wrote on 29 April 2009): "Hi, I apologize for not responding sooner. Absolutely, I would be more than happy to receive any information regarding the DOC that you feel would be helpful...."
.........I was prompted to write on 4 January, 2010 that you and your boss, Governor Patrick -- were indeed "poised to take swift action."

But before I wrote that blog entry I hand delivered the complaint and request for information seen above on 29 December, 2009 and I have not heard back from you.

Since that time I have seen you take action on the missing emails, as noted. Meanwhile I've been busy with the Mayor's Office and other offices in City Hall getting downtown parking for motorcycles and scooters, and getting my neighborhood cleaned up. Meanwhile this blog has helped put Joanna Marinova in touch with seasoned Defamation/First Amendment counsel who are suing the Boston Herald and Channel 7 for Defamation. The information that was unlawfully leaked provided the foundation for the offending conduct from the two Defendants.

But the CORI issue is still sitting there in a black abyss. Your boss told me in the video below that he was going to take care of this thing, i.e. "put it to bed."watch him in this KingCast video.

Has Governor Patrick given you any instruction on it? He told me in video he was going to conduct a thorough investigation. Do you care about this situation? Please provide a copy of any and all documents that prove your office has undertaken any investigation into this CORI violation and attendant Defamation issue.

It's no secret that I question you and your Republican buddy to the North, Kelly Ayotte. After all, you both have made up some fantastic stories or issued coverups about men with knives.

I'm certain you will assuage my concerns with a series of documents demonstrating your concern and Due Diligence on this matter.

When I saw the hits coming from Oregon I thought it was my old pal and another do-goodnik lawyer Lara Johnson from the Case Western/Diebold days, or Parliament of One blog, whose brother was jacked-up by Bad Cop Brian Cox on Corvallis, but in fact it was not. In fact it was Black, Chapman, and in fact these cats are some of the biggest, baddest attorneys in Northern California, and cool cats who run video choose KingCast and KingCast65 on YouTube.

Lawyers are some of the most backwards, slowest groups of people when it comes to technology, but some lawyers get it, including Boston's India Minchoff and Steve Kuzma, featured above. They recently secured an historic $1.7M verdict in the Anti-Semitic housing case of Scott Hyman v. Hemlock Association in Lakeville, MA. I'll be calling the Court today to check up on the JNOV/New Trial Motions.

Courtroom, settlement and Day-in-the-Life videos are where it's at, and I've been running video from my own trials back in the '90's as I noted above and in this post and in this post. Moreover, several years ago we successfully used settlement video in our case against the overtime-abusing, stock option-backdating racist scumbags at American Tower Corporation, as noted in this Omar Thornton/Budweiser post.

Soo...... I don't know what the exact facts are, but I have read from a NY Daily News link in this Christian Science Monitor feature that race was at issue. This from a publication I trust more than just about any other:

"If you called him a n----r he would go off," she said. "But he kept it inside. He kept it all bottled up."

Thornton's best friend, who asked the Daily News to keep his name confidential, said he also used to work at the beer distributor and saw Thornton subjected to racist taunts.

"No one should have had to endure what that company put him through," the friend said. "Stuff on walls. Racist comments. I saw it with my own eyes."

The friend said Thornton was hired as a driver but put to work loading boxes in the warehouse and had to fight to get behind the wheel.

"He had someone write a statement asking why he couldn't drive, and that's when they put him on as a driver," he said.

The company and Teamsters union say Thornton lost his job Tuesday morning after being confronted with video evidence that he was stealing. His friend and girlfriend don't believe it.

"Omar stole beer? The dude didn't even drink. I don't know what he would do with it. He wasn't the stealing type," said his buddy. Hannah said she thought he was being set up.

"A few weeks ago, he told me that the company wanted to get rid of him," she said. "They were looking for a way to get him out of the company and paint him as a problem. That they were going to pin something on him and get him out of the company."

Thornton, she said, was pushed to edge by bigots who wanted to take him down a few pegs. She said she crafted a letter for him to the Budweiser company - a letter he signed - in which he detailed the racist abuse.

"He heard people say he got promoted (to driver) because he was a n-----," she said. "That's when on the bathroom wall he saw a noose and the words "Kill all n-----s."

Thornton took photos of the racist graffiti, she said.

"I saw with my own two eyes his cell phone pictures. These people are lying. The proof is on Omar's cell phone."

The taunts escalated to on-the-job sabotage, she claimed.

"Sometimes his coworkers would pack the trucks the wrong way just to give him extra work," she said. "He was one of only two black guys in the whole company and they were both treated as outcasts. As misfits."

Hannah said that Thornton's union rep didn't support him.

If that is true, I appreciate the loss of lives but I do not appreciate the attitude. Similarly, here is a forum board full of contempt for All Things Jewish, which I cannot appreciate either.

What I can appreciate is this:
1. Responsible government officials who prosecute and settle workplace abuse issues, such as the $290K DOL fine...err....settlement with American Tower Corporation after I, as a black man, wrote a letter on behalf of one of my trainees who reported them to the DOL.

2. Responsible private attorneys who made American Tower pay $14M for backdating stock options. KingCast was there, Boston Globe was not.

I was employee of the week but I guess that's only as long as I kept my mouth shut..... Other employees who supported me (Caucasian female and a male, black) were hassled and fired but we hung in there and sued those scumbags, led by HR VP Aileen Torrance, Esq, see how she filed a false Affidavit. The money they ended up paying to us was a pittance to what they own, but the Good Thing is that all of us kept our heads high, took the legal route and told them to go to hell.

At any rate, I can't possibly know what was on that brother's mind when he went off like that, but for anyone who is upset about Corporape Amerikkka please put your finger in the dial, a hand on the shutter and spend a minute inside final cut pro or iMovie '09 before you put your finger on the trigger. This way they can never claim victory over you. You'll be alive, out of jail and marching forward in America, the Home of the Free.... Land of the Brave.

Soooo..... I don't just help clean up Big Dig urban blight in Southie/Dorchester, I help out in Massachusetts in general:

Senator Tarr has always been a Champion of the less-privileged, and Robert Taylor, despite being a Great Guy, was his target constituent. He died in a totally illegal apartment in an uninspected building, and that's a FACT.

That's why the Gloucester Times celebrated Senator Tarr's introduction of Robert Taylor's Law, S8013, after I conceived it and forwarded same to him for polish and final drafting. As noted by the paper on 1 Feb. 2008.

"The residents of the Lorraine were apparently never notified of their building's hazards. But they — and other residents of such buildings around the state — would have that right if this new proposal were to become law.

Now that would be a fitting legacy for Mr. Taylor."

Look: Robert Taylor died in an illegal apartment with ingress and egress only through another floor, and that's a fact, Jack. Read more about it in this Gloucester Times story by Richard Gaines. The paper won an award for its coverage, huzzah!

You remember Michael Holman. Update...... I forgot about my taped January, 2009 phone call with Jake Wark about this, before he and DA Conley got nasty with me.

Sooooo....I wrote a comment to Robin Kaminski's Daily Item story and I presume it will appear on their page later. I didn't bother suing for the video myself because I knew the Item was on it, and I also knew it doesn't show too much. That having been said, I think I will go watch it now too just to make sure. Anyway, remember as you can see in the second video, DA Conley rudely and unprofessionally refused to answer a simple question I posed to him while his sidekick PeeWee Herman/Jake Wark laughed like a damn hyena -- despite the fact that I only had good things to say about him on this blog to that point. Well you asked for it, guys, so now you get it.

Conley’s office repeatedly denied the newspaper’s request, citing investigatory exemptions that suggested releasing the video would compromise the integrity of the investigation. Conley agreed to release the footage Tuesday if The Item dismissed its litigation.

“We have agreed, through our attorney Peter J. Caruso Sr., of North Andover, to drop this legal action against the Suffolk County DA’s office now that they have produced the footage that we have always maintained was public information,” Daily Item President and Publisher Peter H. Gamage said.

On the Peace Out picture, you just can't compose it any better, it's uncanny. And the chill thing is, it just happened that way. I'm a rhythm photographer not a blast photographer, so I just wait for the natural and there it is. Lookit how the blokes are all in the Right Position, the trash can is even in the right place, in front of the door, and the angle of the broom in it echoes the shovel leaning against the dumpster, nice.

This will eventually be the third of three KingCast short films documenting the cleanup of a much-neglected area of Boston's Southie/Dorchester neighborhood. Y'all remember the second video (on top) in which the CMG promised me they would be out with the quickness, and guess what?

Soooo.... I asked in this post whether Dan Conley and the Jury wrongly convicted Robert Iacoviello, Jr. for the murder of Revere Police Officer Daniel Talbot.

I noted in this post about State's witness, purportedly altruistic "Bat Man" Jason Watson, that my buddy Seth Daniel discovered an eerily familiar fact pattern of violence and deception on the part of Derek Lodie and Michael Picardi.

Now Derek Lodie has taken an extension on his 20 July 2010 trial date and many believe he is going to Cop a Plea, just as he did in the Dan Talbot case.

Safe to say that if the Revere PD had arrested Derek Lodie for these events when they should have, Dan Talbot would be alive today, and Robert Iacoviello, Jr. would be a free man, taking care of his child as people have written to tell me that he always did in a kind and considerate, loving manner..... in opposition to Jason Watson, who has physically threatened the mother of his child and her family. I know for fact that his Restraining Order was extended.

And I again remind you that Officer Billy Soto's testimony put the gunfire flash in Derek Lodie's hand?

Now I am going to post a good segment of Seth Daniel's Revere Journal story:

On Sept. 26, 2007, (3 days before the Talbot tragedy) three young men were walking on Cooledge Street in Revere when Lodie allegedly began to approach them.

“What are you doing in my projects?” he allegedly yelled at them as he walked closer.

Once he was next to them, Lodie is alleged to have lunged at one of the youths. A second of the three youths jumped in front of the attack, and began to fight with Lodie. The third youth also joined in the fray.

Eventually, Lodie ran off into the Cooledge Street development.

Simultaneously, the second youth realized that he had been stabbed three times in the chest and abdomen area – pretty serious injuries. The third youth had a sizable slice on his thumb. Witnesses called 9-1-1 and the injured youths were rushed off to the hospital.

When police arrived on the scene, that’s when Picardi became involved.

Picardi allegedly told police that he witnessed the incident and that it was William “Billy” Bagnera who had stabbed the youths.

However, it turned out that Picardi’s information was a lie. Yet another foreboding situation given what would transpire in the Talbot case just a few days later. Revere Police immediately put out a warrant for Bagnera – who had a sizable record and a lot of criminal contact with police in the past.

Lodie and Picardi escaped to a mutual friend’s house, where they discussed what had just happened while others overheard.

Two days later, Bagnera was arrested and charged in the stabbings.

Despite his innocence, he was held in custody for more than two months before police were able to point the crime at Lodie and Picardi. One day after police arrested Bagnera, Officer Talbot was murdered behind the high school after starting an argument with Lodie as he walked by.

Lodie is represented by Attorney Jay Carney, who also represented him in the Talbot case. Carney had no comment on the upcoming trial, which is scheduled for a July 20 start in Boston’s Suffolk Superior Court (continued to 11 Aug 2010).

Paul, you and I both know this is a walk that we have to take, no disrespect to your brother in the least. It's about respect for the Constitution and whether a young man is doing time for a crime he did not commit, and whether others got passes for any potentially criminal conduct on their parts.

KingCast.net presents the Fourth short film in its “Bowfinger or Bad Blood” series about history of government malfeasance that led to the Franconia shooting tragedy of May 11, 2007 that took the lives of Liko Kenney and Norman Bruce Mckay and the community’s reaction to it.

This is perhaps my favorite Franconia short film including the original one over at the KingCast movie page because of its balance between art, entertainment and politics. The point is made but the viewer gets a chance to relax at the same time, and to catch a glimpse of what the people of Franconia are all about, and its not all about being anti-cop, etc. etc. blah blah blah as some would have you believe.

I told the entire Free World three years ago that I was the only film maker authorized by the family of Liko Kenney to shoot, edit and produce movies about this tragedy, although they (and I) most certainly welcome any and all earnest attempts by anyone, including but not limited to Casey Sherman to raise consciousness about this situation.

First of all, she claims that she "only" published it to 12 people in the Legislature. Guess what? That only goes to damages, Martha... you idiot. So what if you "only" lied to 12 Legislators, you made the comment without any sort of Executive Privilege, and you're still a stinking liar and quite deceitful, same way you went behind the backs of the Franconia Recovery and Reconciliation Committee folks to initiate failed HB 1428, see generally "Cool Cats" series, infra.

Second, I don't believe her. Gionet must demand all of her emails, public and private within the relevant timeframe. I couldn't get them in my lawsuit but I'll betcha' he can. Judge Vaughn can't run that same game he ran on me, hahahaaa....

Third, it was still imminently foreseeable that future publication would ensue (pardon the play on words, hahahaaa...).

Fourth, she also lied about me: as she accused me and others of

"threats of physical and sexual violence."

Note: The first real movie my father took me to was Papillon, when I was about 8 years old. My father and I never walked the traditional subservient path lain out for most negroes who made their way up to the North in the great black diaspora of the 1950's, although he did end up working for about 40 years for a bunch of scumbags formerly known as Diamond Shamrock. He eventually become a certified chemist in the early 80's, the first black to do that there. My mother worked for another corporate behemoth as an HR Specialist, and they were the first blacks to be doing what they were doing in their respective fields at their companies and damn near anywhere else in Cleveland. We were one of the first black families in our area of Cleveland Heights in 1970, yes there was related litigation, Heights Community Congress v. Hilltop Realty, not going into that now look it up if you want.

.......And that in turn paved the way for Yours Truly to go to prep school (Hawken video) to bring you KingCastic events and trial coverage and commentary as no one else does, at least not here in New England I've never seen anything like it. It also led me to meet my old friend and former Hawken debate teammate Josh Breslau, who unfortunately has left Boston for California after his Post-Doc at Harvard. See I believe that's Dr. Lawrence Breslau (RIP) sitting next to my father in the late 50's at Cleveland's Hanna Pavilion (photo actually Jan 1963), where he was the first black orderly. Nowadays they got nigra' doctors and stuff, but back then, you had to build your way up from working on a cleaning contract with my Uncle to even be an orderly. Look how smiling and happy he was before I showed up in '65, LOL!!!

Taking a break for a few days from the Courtroom crap, it kills you if you don't let up on it every now and then. Meanwhile I'll be working on the new bike video on last week's trip to East Coast Motors for a new chain & sprocket set on the 650R (ER-6) later this morning after an inline skate.

Defendant Hemlock Association's Motion for Judgment Notwithstanding the Verdict/Motion for New Trial:
Chiefly it argues that there was not enough indirect evidence to infer that the Association members committed any of the violations complained of. I did not see the entire trial but I did see at least two witnesses testify that they witnessed trespass, as shown in my videos. There are also arguments that the Defense was kneecapped by not being able to introduce evidence they claim could show that "renegade motorcycle clubs" could have burned out Mr. Hyman's Middleboro home. Defendants also claim that they should have been allowed to mention Mr. Hyman's bankruptcy filing but of course if they are permitted to broach that subject then he will be permitted to delve into the attorney fees and costs he has had to pay in the other litigation that he will allege broke his wallet and left him unable to tender an effective subsequent bid on the property. Stay tuned for the Plaintiff's Reply Memorandum.

10:30 a.m. 12 June update, Plaintiff's response:
Okay, I missed several days of trial because I was traveling. Attorney Minchoff is expected to argue on the swastika/feces/urine/picnic tables through the windows that Scott Hyman did produce testimony at trial that Bren Ladino told him "I didn't do it but I'm not saying someone else in the association didn't," and that Ronald Dufresne told him "I don't know who did it but your kind is not welcome here."

This in conjunction with the now-infamous "You wouldn't want to wind up like a buoy would you.... that's a dead fucking thing that floats in the water....."

Objection! you scream..... You can't have Scott Hyman talking about the damages to his house because there's only inferential proof that anyone tied to the Association did it. Well that's a great argument..... except it wasn't made at trial, where the Defendants had only a standing objection to Hearsay. But the Hyman & Prescott observations of the degradation of their respective properties is not Hearsay.... it's a firsthand event, so now the Motion for JNOV is basically asking His Honor to strike that which was not objected to. Once the Jury had the testimony it was not unreasonable for it to find a Causal.

So I don't like Defedant's chances on that, but perhaps the Association could sue Attorney Serkey for malpractice if this is such a key point and he missed it, and then his insurance carrier could settle it up with the Plaintiffs. That would make a nice and tidy picture..... I wouldn't know, because while I was never a "Superlawyer" I also never got sued for malpractice..... I only help people recover for malpractice claims, i.e. Derrick Gillenwater v. "Superlawyer" Jeffrey Denner hahaha.... (Harvard Citizen Media blog coverage).

But alas, I digress. Also interesting is the admission that Hemlock buddy Steven Berk likely committed the arson at Mr. Hyman's Middleboro home (p. 11) but only to get rid of some DNA evidence as opposed to because of Mr. Hyman's Jewish background. Oh, okay, that's cool then..... my bad, dude.

Lastly, there is a reference at page 12 to some allegedly threatening words that Scott Hyman said to a customer about burning houses down. The Motion reads "We [were screwed] because we were precluded inquiry into an intense dispute going on in April, 2006......"

KingCast review of the matter, including a phone call to the hosting newspaper, reveals that the story was written by a reporter no longer at the paper and that the story was written on 4 June 1995. I knew that, I could tell that because of the cars involved. Fascinating.

Michael Holman's son was in a coma after his opiate-afflicted mother allowed him to ride a bicycle without a helmet. But when he fought for custody Kelly Ayotte and her band of legal misfits launched a massive smear campaign against the guy, false arrests and false accusations, the whole nine yards. Now a Congressman has begun a formal inquiry into the actions of NH lawmakers.

NH AG refuses to reinvestigate. The mother was found guilty of Physical Neglect as my son almost died after being hit by a car. She publicly stated in Newspaper that she told Ryan to put on a helmet before the crash. She has admitted this to be a lie. She owned no helmet..... Like Michael Holman, the exercise of my constitutional rights in a child custody case led to being targeted by NH and federal law enforcement officials for challenging a racially motivated custody ruling that implicated the NH Family and Supreme Courts of RACISM. I was falsely arrested for threatening state and federal court and law enforcement officials. The district court found there was no crime, no threat and that the State could not meet any of the elements of the crime charged.

Here's the post that describes it all, and it all goes back to Martha McLeod being a deceitful, lying hussy legislator on HB 1428 and on SB 154, she used her email address from another employer to circulate the current false and vitriolic statements, with Actual Malice and Reckless disregard for their truth, that State Rep. Gionet was peeved at Bruce McKay because McKay wrote him a ticket, and that I was involved with people who were physically threatening her and making sexual threats.

She's lost her friggin' mind, watch my short film above about her and her hear and smell no-evil hubby.

See I'm laughing my ass off because I sued her for her emails a coupla' years ago on a directly related issue and protectionist Judge Timothy Vaughn tossed my case out as soon as he could, and because I didn't Motion for Oral Argument as I did in the first lawsuit of KingCast v.
